Default How would you handle this?

Hi guys first time posting here. I have a problem I'm hopping someone can give me some advice on. I recently purchased a used glow truck (brand no important) from a fellow member here that was supposed to be in used good condition. When it arrived it was anything but. It should have been listed as used poor, that's how I would have done it anyway. Here is my problem. I wrote the guy who after several emails agreed to refund me most of the purchase price. No it was not through Paypal and have learned my lesson there, never again deal with anyone who doesn't have Paypal. Yeah not everyone likes or has them, too bad, I'll spend my money with someone else who does. Anyway, it's been several weeks since his last email telling me he doesn't operate that way and he's a stand up guy. Yet to date I still am out the money. Any advice? I refuse to write it up as a lesson learned. Can I call the local sheriff deputy and have them talk to the guy? It's not worth an attorney to get involved, but I'm sorry this is BS! You don't do this to people. I haven't listed his name yet, but will smear it all over the internet if I have to, especially here. OK, sound off.

i don't think the cops can do any thing about it because you got the car now if he stiffed you then you would have something just give him a poor rating feed back and be careful next time

I can't give him poor feedback. I left the feedback alone with the idea I would leave feedback after the refund was given. He has since rejected the offer so I can't do anything. I'm willing to try the police dept to police dept idea. I have until tomorrow afternoon till I plan on going forth with any action. On my last email I told him I'd wait till this Friday, mail gets here around 3:30p

And no I don't have the car. As part of the agreed refund, I was to send the car back! Perhaps not the smartest thing, but it was a piece of crap!

Yeah, that's a tough situation. First of all, you should keep on asking the guy for your money. Try to be polite, but firm with him. Let know that if he doesn't refund the agreed amount of your money you're going to make everyone aware of the kind of business he conducts. You can try with the sheriff like you say, but I imagine that can get hairy with the two of you being in different jurisdiction areas and such legal technicalities.

i got scammed once online. heres my tips:

-leave him 400000000 million messages and otherwise badger him as much as you can.

-google the IC3 website and file a report.

-find your police dept. website and file a citizen to police report.

-call his police dept. and see if they can do anything.

-whitepages.com the information you have on him and see if theres someone you can talk to who knows him (wife, parents, etc)

is he in the country? do you have his address? paying
someone a visit (not in a bad way) can get things done.
people turn there phones off and cops usually dont do much.
leaving messages i would say, may do nothing. if its overseas
you may have to wear it. i got burned once on a set of tools.
never saw the tools and was out money. but i learned.
there is some scum out there and it actually surprises me
how decieving people can be. i got a gas truck too from someone,
and i pulled it down, the diff was melted and the insinde of
the clutch had heavy grooves in it.(it had been thrashed)
apperently the motor had a sleeve and piston done.-apperently.
i wouldnt give that motor away to someone. keep on it, i
genuinly hope you get your money back.good luck.

Oh yeah. Name and address. Kinda don't want to travel to Georgia, would cost more than I'd get back.

In all honesty, there is very little you can do. The police will not be very intersted without a crime, such as theft, which technically hasn't occurred here, since you did get the item in question.

It is not worth the effort, cost and stress to follow this up unless we're talking hundreds of dollars.

You're probably totally SOL on this one. It sucks, but it does happen. As you learned, try and only deal with PayPal accounts, ALWAYS get a tracking number for packages, and carefully read through feedback. All of this will help to prevent you from getting screwed again. I'm pretty sure RCU can't provide you any recourse, but you may want to write a mod and find out.

If it were me, I'd continue to e-mail him at probably a rate of 5-10 e-mails a day, provided you have the time. Look up his phone number, and CALL, CALL, CALL him continuously. You can't get a harassment charge for trying to get YOUR money from him.

I don't know how much you paid for the RC, or how much you've lost, but plane tickets can be quite cheap now a days. If it was, say, a $600 RC than it may be worth it to spend $100 on some round trip tickets on an economy airline to Georgia(I know when I fly from Michigan to Florida on AirTran it's only about $75-150 round trip). Before doing this though, I would contact HIS local PD and fill them in on the situation. Then, tell them you plan on coming to collect from him and would like a police escort to do so. You wouldn't want to show up at his place only for him to release the hounds and put a gun in your face, and that does happen!

Hopefully you get your money back, but unless you physically go pay him a visit with the cops they won't do anything.

OK, here is the latest. According to local police the best it could be considered is an ordinance, trying to get my money back would best be done through the courts. I don't consider this an option because we're only talking about $120. Doesn't sound like much, but keep in mind since this happened I've lost my job. Company sold out and new owner had his own employees. So with this said I will devulge who this jerk is so no one else falls victim to him.

His name is Lenny Leonard, 4280 N Braves Circle, Douglasville, GA 30135. His RCU name is "EASTWOOD." All caps.

Worst part is he does have good feedback, not all good, but majority is good with only one OK, three poor. He also doesn't have Paypal, again this should have been my first warning.

So to all of you that gave me information and ideas, I thank you for your time. I will continue to write him in hopes of seeing some kind of refund. To the rest of you be forwarned. DO NOT DEAL WITH EASTWOOD, he will rip you off.

Funny thing is Yahoo maps shows his house in thier satallite pictures. New house, new development, culdesac. Guess he's selling the junk from his basement to pay for the new house

If not, the kids probably make fun of him at school with a name like that.
